Earth Etch is responsible for the collection and processing of your Personal Data in the possession of Earth Etch that is within the scope of this Website Privacy Policy (this “Policy”).
2. Introduction to Earth Etch
Earth Etch is a consultant to energy companies and business professionals on federal and state energy regulation in (and only in) the United States. Our website www.magnifyi.com (the “Website”) and our services cater to a wide range of business professionals – some casually exploring topics, others becoming registered users of our services through the Website (“Users,” “you” and other corollary words). As a User, you’ll access content such as articles, blogs, newsletters, webinars, videos, events and more. You may also engage with advertisers on the Website (“Advertisers”) which may offer products or services aligned with your interests.
To provide content on the Website for free, Users agree to receive content, ads and communications (including for our own sales and direct marketing activities) from Earth Etch and our Advertisers (the “Services”). Users can always unsubscribe from any Earth Etch communication at any time.

Earth Etch collects Personal Data from business professionals who register or subscribe (such as to a newsletter) as Users, visit the Website, or show interest in our Services. This typically includes information commonly found on a business card, such as name, job title, company and contact details. We also collect personal and professional information from third parties which we combine with your data to enhance and supplement our records, to ensure it remains accurate, and to help personalize the delivery of our Services.

- Personal details: given name(s); preferred name; photograph; preferences; personal photo/image; and account settings.
- Contact details: telephone number; email address; mailing address; and social media profile details.
- Professional details: professional profile details; association Userships; qualifications and company insight data.

Depending on the nature of your interaction with us and applicable data protection laws, you may have actively given us your consent (i.e. opted in) or we may be entitled to rely on your implied consent or legitimate interests to market to you.
- For our Advertiser Facing Marketing Services: Earth Etch will combine the Personal Data that we collect from you with Personal Data collected from trusted third-party sources. This information can then be used by, or for the benefit of, our Advertisers in different ways as part of our Service offering to enable our Advertisers to undertake tailored and targeted advertising campaigns.
- Marketing Communications: Communicating with you via any means (including via email, telephone, text message, social media, post or in person) news items and other information in which you may be interested, subject to ensuring that such communications are provided to you in compliance with applicable law.
- Log Files: We use IP addresses to analyze trends, administer the site, track users movement, and gather broad demographic information for aggregate use. IP addresses are not linked to Personal Data.
- Disclosing Personal Data to our Advertisers: Earth Etch will NOT disclose Personal Data to our Advertisers.
- Communications and IT operations: Management of our communications systems; operation of information technology (IT) security; and IT security audits.

13. Data Transfers
In accordance with applicable laws, your Personal Data may be transferred to, stored at and processed by us and our third-party providers outside the country in which you reside, including the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. We comply with the Data Privacy Frameworks as noted below and have adopted Standard Contractual Clauses and/or another appropriate legal basis for transfers of Personal Data, as applicable.
14. Data Privacy Framework
Earth Etch complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Earth Etch has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Earth Etch has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Where appropriate or required to do so, we will give you an opportunity to opt out where Personal Data we control about you is to be disclosed to an independent data controller in a manner not specified in this Policy or is to be used for a purpose that is materially different from those set out in this Policy. Requests to opt out of such disclosures or uses of your Personal Data should be sent to us using the details provided in Section 22 hereof on how to contact us.
Earth Etch receives personal data about individuals in the EU, UK and Switzerland, including website visitors, Users, service providers, contractors, and other third parties. The personal data collected, its purposes, its uses, and the third parties to whom we disclose such data are described in Sections 4, 5 and 8 hereof. Earth Etch remains liable for all onward transfers of personal data from the EU, UK, and Switzerland to third parties who process personal data in a manner inconsistent with the DPF, unless Earth Etch can provide that we are not responsible for the event giving rise to the damage.
As previously stated, Earth Etch is a consultant to energy companies and business professionals on federal and state energy regulation in (and only in) the United States. However, Earth Etch is adhering to the DPF principles. Earth Etch is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC). In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
EU, UK, and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the DPF or otherwise wishing to access their personal data, limit its use and disclosure, or exercise other applicable data privacy rights should first contact us using one of the contact methods provided in Section 22 hereof.
In compliance with the DPF, Earth Etch commits to refer unresolved complaints concerning our handling of personal data received in reliance on the DPF to JAMS, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF-related complaint from us, or if we have not addressed your DPF-related complaint to your satisfaction, please visit the Website for more information or to file a complaint. The services of JAMS are provided at no cost to you.
If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. This Policy may be amended or modified from time to time consistent with the DPF.

Authorized Agents who have the regulatory authority to submit a request shall contact us by email to submit rights requests on behalf of individuals from whom they have received prior authorization to act on their behalf.
In order to ensure the security of an individual’s personal data, we ask that all requests from Authorized Agents be submitted via this method. Evidence of a signed authorization to act on behalf of the individual that is the subject of the request should be submitted as a PDF as part of this process. Authorized Agents must also attest to their legal authority to submit information on behalf of each individual they represent.
