PUCT Staff File Motion to Dismiss Renewal of Retail Pilot in SWEPCO

On March 9, 2026 Staff of the Public Utilities Commission of Texas (PUCT) filled a motion to dismiss  the East Texas Salt Water Disposal Company (ETSWD) petition for the renewal of a retail pilot in the Southwestern Electric Power Company’ s (SWEPCO) service area. This petition was filed back on July 7, 2021.

From Motion to Dismiss:

Staff moves to dismiss this proceeding without prejudice and without a hearing pursuant to 16 TAC §§ 22.181(d)(6) and (11) for failure to prosecute and other good cause shown.”

“The last substantive filing made in this docket was July 27, 2021 by ETSWD. Since that date, no party has made any substantive filing, argued any position, or requested any relief or action by the Commission. A five-year failure to file anything of substance should be deemed to be a failure to prosecute.”

“Moreover, there is no mechanism under state law or Commission rules that would grant ETSWD the right to petition the Commission for the implementation or renewal of a retail pilot program, and no party has provided any support for this proposition.”
