NJ BPU Seeks Comment on “Successor Solar Incentive” Program Straw Proposal
New Jersey Board of Public Utility (BPU) issued a Public Notice seeking public comment on the “Successor Solar Incentive Program Straw Proposal,” (i.e., “SuSI Straw”) released today.
The proposal includes draft rule amendments for the SuSI Program, the Renewable Portfolio Standards (“RPS”) and solar alternative compliance payments (SACPs), and the General Provisions of the Chapter 8 Renewable Energy rules, specifically:
- New subsections (c)-(f) in N.J.A.C. 14:8-1.3 with proposed language to codify the Contractor Remediation Procedures currently outlined in the Board Order approved on January 25, 2017.RPS values for the percentage of energy supplied that was generated in the form of Class I Renewable Energy Certificates (“REC”’s), in N.J.A.C. 14:8-2.3.
- Codification of the process by which the EDCs are to issue refunds of SACP moneys to ratepayers, in N.J.A.C. 14:8-2.10.
- A clarification on the three percent discount rate used to calculate the social cost of carbon in N.J.A.C. 14:8-2.12.
- A series of modifications to the rules applicable primarily to facilities in the Administratively Determined Incentive Program, with some changes pertaining to facilities in the Competitive Solar Incentive Program pursuant to N.J.A.C. 14:8-11.
Additionally, Staff seeks input on a series of related questions for the SuSI Program and welcomes feedback on other areas of the draft rules.
The deadline for comments on this matter is 5 pm on Monday, April 20, 2026.
