As background, the Public Utility Commission of Texas (PUCT) oversees the energy efficiency programs delivered by the state’s eight investor-owned electric utilities (IOUs).

TDU Load Management Programs for Winter 2022-23 will be operated according to the following terms:

  • ERCOT will deploy Load Management Program MW only in Energy Emergency Alert (EEA) Level 2 or 3;
  • ERCOT will deploy Load Management Program MW as a part of the Transmission Operator hotline call for the EEA Level 2 or 3;
  • deployment of Load Management Program MW can occur at any time of day;
  • each TDU will notify each customer contracted under the Load Management Program to curtail when the TDU receives the deployment from ERCOT, so long as the customer has not exhausted its contractual obligation;
  • a TDU may terminate deployment of a customer if the deployment exceeds the contracted duration of deployment or the contracted maximum hours of deployment; and
  • each TDU must notify ERCOT of its total procured Load Management Program capacity at least one business day before the start date of its Load Management Program.
