Hearing Examiner Issues RPS Procedural Order
Re: MEPUC opened this proceeding primarily to set an initial alternative compliance payment for Class II resources.
Hearing Examiners issued procedural order. Of note, “Competitive electricity providers may use the alternative compliance payment” for Class II resources, effective 12/2/23, “to satisfy the portfolio requirements described in 35-A M.R.S. § 3210(3) for reporting year 2023”
As background, this proceeding was opened in response to a new state law, which allows competitive electricity providers to satisfy the RPS requirements for Class II resources through an alternative compliance payment mechanism. The law directs the MEPUC to set the ACP rate by rule, at an amount not to exceed $10 per MWh.
The new law also extends the time period for the 300% multiplier for the output of a generator fueled by municipal solid waste in conjunction with recycling that has obtained a solid waste facility license from the Department of Environmental Protection. It also directs the MEPUC to use ACPs for Class I, Class IA, and Class II resources to provide financial assistance for low-income households.
