Another Related Michigan Zoning Enabling Act Bill Passes In Michigan

HB5121 bill amends the Michigan Zoning Enabling Act to establish that a renewable energy project that received special land use approval on or after January 1, 2021 is considered a prior nonconforming use and the special land use approval cannot be revoked or modified if substantial construction has occurred or if an expenditure equal to 10% of project construction costs or $10,000.00, whichever is less, has been made.

Passed both the House and Senate on November 8, 2023 and was subsequently signed by Gov. Whitmer.
