VA Gov. Signs Bill to Study Demand Response Programs

On April 13th as amended on March 11, 2026 SB43 was signed by the Virginia Governor.

This new law becomes effective on July 1, 2026.

As amended this bill directs the Department of Energy, with SCC, to investigate the impacts of and best practices and implementation recommendations for demand response (DR) programs, reporting findings and recommendations to the legislature by November 1, 2026.

In addition, current and prospective existing DR programs and participation, DOE and SCC are to consider potential requirements for DR programs to:

  • meet minimum reliability and resource adequacy standards;
  • reduce customer energy consumption, including during grid emergencies;
  • avoid increase in local air pollution; and
  • be cost effective.
