PUC Seeks Comments on Proposed Changes To “Reasonable Arrangement” Rule
On July 8, 2026 the Public Utilities Commission of Ohio (PUCO) issued an order inviting interested parties wishing to file comments or reply comments with the Commission regarding the proposed modifications in Ohio Adm.Code Chapter 4901:1-38 addressing reasonable arrangements for electric utility customers.
This rulemaking is part of the Commission’s obligation to review their rules every five (5) years to determine whether the rules should be continued without change, amended, or be rescinded.
Therefore, the Commission has opened this docket to review the rules regarding reasonable arrangements for electric utility customers in Ohio Adm.Code Chapter 4901:1-38.
“Staff evaluated the rules contained in Ohio Adm.Code Chapter 4901:1-38, stakeholder feedback provided at the April 8, 2026 workshop and recommends both substantive and non-substantive changes throughout the rules.
“Non-substantive changes are intended to improve clarity, streamline language, or correct typographical errors.”
“Some substantive changes include the removal of non-mercantile eligibility and Ohio Adm.Code 4901:1-38-07.” More specifically, Staff’s proposed draft rules would eliminate the current ability for non-mercantile customers to enter into reasonable arrangements, instead limiting reasonable arrangements to mercantile customers.
Another substantive change recommended by Staff includes shortening the comment filing period.
Note that attached to the order are the proposed Ohio Adm.Code Chapter 4901:1-38 (Attachment A) and the BIA for this chapter (Attachment B).
Comments are due no later than July 29, 2026, and August 12, 2026, respectively.
