PUC Staff Oppose Supplier’s Motion to Strike Testimony Re: Calculation of $1.44M Forfeiture Amount

On July 27, 2026 Staff of the Ohio PUC filed a memorandum opposing Green Choice Energy’s motion to strike testimony submitted in a remand proceeding concerning the calculation of the company’s forfeiture.

Staff argues that the Ohio Supreme Court upheld the PUCO’s findings that RPA engaged in numerous unfair practices and lacked managerial capability, remanding the case only to require the PUCO to better explain the evidence supporting the $1.44 million forfeiture. According to Staff, its remand testimony introduces no new evidence but instead clarifies the existing record and the methodology used to calculate the forfeiture.
