Staff Files Memo Indicating More Updates to Competitive Electric Rules
On August 10, 2026 Staff filed a memorandum stating that the Delaware PSC is reviewing and updating its rules for electric suppliers to improve customer protection and make the electric-choice process clearer. As stated in this memorandum, the review followed customer complaints about high bills and confusion over third-party suppliers. The proposed rules improve customer notices, rates, enrollment, and marketing.
As reported previously, on August 6, 2026, the Delaware PSC issued an order adopting amendments to Regulation 3001 that strengthen pricing disclosures, contract and renewal notices, enrollment requirements, and marketing protections for retail electric customers.
As reported previously the amendments among other things require clearer pricing and contract disclosures, including information on variable rates, fees, cancellation provisions, and renewal terms. Suppliers must provide 45 days’ notice of contract renewals, with additional notice when a fixed-rate contract converts to a variable rate that is at least 30% higher.
The rules also strengthen enrollment protections by requiring customer authorization, recorded telephone sales calls, and enrollment notices.
The rules also prohibit deceptive marketing and hold suppliers responsible for their agents’ conduct, while adding safeguards for the use and sharing of customer information.
The amendments become effective 75 days after publication in the Delaware Register of Regulations.
On July 29, 2026, after reviewing comments from Delmarva and RESA, Staff recommended final publication of the revised rules.
