PUC Seeks Comments on New Intervenor Compensation Program

Category: Rhode Island

On October 1, 2026 the Rhode Island PUC issued a notice soliciting comments on recommendations for establishing an intervenor compensation program.

Comments on establishing an intervenor compensation program are due November 1, 2026.

“An intervenor compensation program would need to include eligibility requirements, proceedings to which such a program would apply, standards for awarding compensation, funding mechanisms, and administrative procedures for such a program. During the 2026 legislative session, the General Assembly considered legislation concerning intervenor compensation, including 2026-H 7890 and 2026-S 2727, the “Equitable Participation in Utility Regulation Act.” The proposed legislation provides one example of how an intervenor compensation program could be structured. Among other provisions, the bill contemplated eligibility requirements for intervenors, compensation for specified costs, a determination of financial hardship, an application process, and funding through a state appropriation and, under certain circumstances, ratepayer funds. The bill also addressed the proceedings and participants that could qualify for compensation. Commenters may use these bills as starting points or for examples of statutory language.”

“The Commission is particularly interested in recommendations that would establish clear and objective eligibility standards, ensure that compensation is directed to meaningful participation in Commission proceedings, minimize administrative burdens, and avoid unnecessary costs to utility customers. Comments should address how a program could be structured to provide meaningful opportunities for participation while maintaining an efficient regulatory process.”

In its notice the Commission directs parties to address certain questions including comments on focusing on eligibility standards, stakeholder participation, administrative efficiency, and minimizing utility customer costs.
