Commissioner Statement Details Next Steps If PSC is Unable to Reach Majority Decision in Utility’s Rate Case
On October 9, 2026 Commissioner Beverly issued a statement responding to OPC’s motion to stay.
Commissioner Beverly’s statement details next steps:
(1)provided notice that District of Columbia’s PSC “is unable to reach a majority decision on the Stay by October 12, 2026, or anytime soon thereafter”;
(2) said that “assuming that the interim rate is not subject to the same hearing requirement as a final rate, the former majority’s Order establishing the interim rate should have given the conditions under which the interim rate will terminate so that it does not inadvertently become indefinite”; and
(3) recommended District of Columbia PSC “immediately consider amending [the interim order] to state that ‘If a final rate has not been authorized by December 31, 2026, the interim rate shall terminate and the rate shall be the filed rate in effect on December 31, 2024, and it shall remain the rate until a new final rate is authorized’.”
Previously on September 28, 2026 Pepco filed a response opposing OPC’s motion to stay.
The prehearing conference is now scheduled for November 17, 2026 and evidentiary hearing now scheduled for December 7-8th 2026.
