SmartEnergy Files Reply For Clarification And Stay Of Order

SmartEnergy is renewing its request for the Commission to issue an Order consistent with the request.

[ *** ] Based on OPC’s response, it is a good thing SmartEnergy filed its Request. The Order directs SmartEnergy to use “best efforts” to pay customers, which is a subjective term and susceptible to different meanings, and the Order includes certain directives that are vague and other rulings that are incorrect. As expected, OPC’s view of “best efforts” and several of the Order’s provisions are different from SmartEnergy’s even though OPC agrees with SmartEnergy on several issues. SmartEnergy filed this Request to gain clarity on the term “best efforts” and to implement a process that, if followed, will not be contested later. All stakeholders would benefit from unquestioned certainty before SmartEnergy pays out what would be the highest dollar amount paid by any supplier in Maryland.
