PULJ Rules On Motion To Proceed Without NDA And For A Protective Order In Investigation Into Gas System Inspection Issues Raised Regarding Baltimore Gas And Electric
From Ruling:
[ *** ] ORDERED: (1) That the Motion To Proceed Without An NDA And For A Protective Order is hereby DENIED;
(2) That BGE is not entitled to designate CIR 1-1.a.i – CONFIDENTIAL Attachment 1 and CIR 1-1.c.i. – CONFIDENTIAL Attachment as confidential in this proceeding and such designations are hereby VACATED;
(3) That BGE shall produce CIR 1-1.a.i – CONFIDENTIAL Attachment 1 and CIR 1-1.c.i. – CONFIDENTIAL Attachment to the Former Employees within three (3) business days of this Ruling becoming a final order of the Commission;
(4) That BGE shall provide support for any and all confidentiality designations contemporaneously with production of any documents in this proceeding, and for documents already produced shall provide support for any and all confidentiality designations within five (5) business days of this Ruling becoming a final order of the Commission;
(5) That in the event of a dispute over BGE’s confidentiality designations and/or support thereof, or a dispute over prior knowledge, the Parties shall meet and confer and attempt to resolve the dispute;
(6) That only after attempting to resolve all disputes should a filing be made in the docket outlining the issue, indicating the attempts at resolution with dates;
(7) That BGE shall seek an order from the PULJ upholding any disputed designation(s) within five (5) business days after a filing by another party;
(8) That with respect to CIR 1-1.b.ii – CONFIDENTIAL Attachment 1, BGE shall file an affidavit within five (5) business days certifying how this specific information has been treated in past cases before the Commission as set forth herein
(9) That to the extent that CIR 1-1.b.ii – CONFIDENTIAL Attachment 1 contains information other than addresses and descriptions and can be redacted, BGE is not entitled to a blanket confidentiality designation and shall produce the document with proper redactions only; and
(10) Any party may file an appeal of this Ruling with the Commission pursuant to Section 3-113(d)(2) of the Public Utilities Article within seven (7) days. Otherwise, this Ruling will constitute a final Order of the Commission on August 21, 2025.
