Additional Workshop Scheduled To Implement New Law

Before drafting new proposed rules the August 5, 2025, ALJ finds that a workshop should be scheduled for August 5, 2025, at 10:00 a.m., at the offices of the Commission, 180 East Broad Street, Hearing Room 11-B, Columbus, Ohio. 

This workshop is intended as an opportunity for Staff to receive suggestions from interested stakeholders before the draft rules are issued for comment. Nevertheless, any interested stakeholder that does not participate in the workshop may still file comments with the Commission once the draft rules have been issued.

{¶ 1} On May 15, 2025, Governor DeWine signed Substitute House Bill Number 15 (Sub. HB 15). Among other items, Sub. HB 15 adopted amendments to sections of the Ohio Revised Code (R.C.), R.C. 4928.08 and 4929.20, as well as adopted new sections R.C. 4928.103 and 4929.222.1 Specifically, the amendments to R.C. 4928.08 and 4929.20 instruct the Commission to establish rules to require competitive retail electric service (CRES) suppliers and competitive retail natural gas service (CRNGS) suppliers, respectively, to maintain sufficient financial assurances to protect customers, electric distribution utilities, and natural gas companies in the event of a default. The new sections, R.C. 4928.103 and 4929.222, require the Commission to adopt rules regarding the customer account information needed to verify identity before switching CRES or CRNGS suppliers. 

{¶ 2} Before issuing any proposed rules, the administrative law judge (ALJ) finds it appropriate to require Staff to hold a workshop with interested stakeholders. At the workshop, Staff may elicit feedback on any proposed rules which Staff may have, and stakeholders may propose their own rules for consideration. Interested stakeholders should come to the workshop with technical experts prepared to provide appropriate feedback. After Staff has an opportunity to consider the feedback received at the workshop, proposed rule amendments will be issued for comments and reply comments by interested parties.

{¶ 3} Accordingly, the ALJ finds that a workshop should be scheduled for August 5, 2025, at 10:00 a.m., at the offices of the Commission, 180 East Broad Street, Hearing Room 11-B, Columbus, Ohio. Interested stakeholders should register at the lobby desk and then proceed to the 11th floor to participate in the workshop. This workshop is intended as an opportunity for Staff to receive suggestions from interested stakeholders before the draft rules are issued for comment. Nevertheless, any interested stakeholder that does not participate in the workshop may still file comments with the Commission once the draft rules have been issued. 

{¶ 4} It is, therefore, {¶ 5} ORDERED, That a workshop be scheduled for August 5, 2025, as stated in Paragraph 3.
