DC PSC Approves Final Revised RPS Amendments

The District of Columbia Public Service Commission (DC PSC) issued notice of its final rule making adopting amendments to DCMR, Title 15, Chapter 9, concerning RPS rules.

As background the DC PSC issued the final rulemaking on November 1, 2024, whereby it proposed amendments to Chapter 29.

No comments were filed in response to the notice of proposed rulemaking (NOPR), “and no substantive changes have been made to the rules as proposed in the NOPR.” 

The rule changes include the removal of references to solar facilities certified by the DC PSC prior to February 1, 2024, from the exceptions to the requirement that Tier One RECs must come from facilities in the District of Columbia or in locations served by a distribution feeder serving DC.

In addition, the following changes will go into effect as result of the amended rule:

  • Deadline for suppliers’ annual RPS compliance reports was changed from April 1st to March 1, 2025;
  • Suppliers now have only have five (5) business days to come into compliance or contest a decision of noncompliance;
  • Tier Two renewable sources are no longer eligible for DC’s RPS program;
  • DC PSC is required to provide a report on the status of RPS implementation to the Council of the District of Columbia by May 1st every year;
  • If there is an alteration or modification to an operating characteristic of a certified facility, the owner or operator must submit an amended application;
  • All renewable generating facilities, including BTM generators and CREFs must obtain the generation data they submit to GATS via revenue-grade generation meter or inverter-based revenue-grade generation measurement equipment rather than through estimates; and
  • RPS account holders must report clerical errors in REC reporting to GATS within 30 days of the discovery and copy the DC PSC.
