SmartEnergy Files Eleventh Bi-Weekly Report

[ *** ] On April 28, 2025, the Commission entered Order No. 91626 (“Enforcement Order”) directing SmartEnergy to, among other things, submit bi-weekly reports on its progress complying with the Order. On June 9, 2025, the Commission issued Order No. 91676 (“Clarification Order”) modifying portions of the Enforcement Order and holding that “[a]ll other directives of the Enforcement Order not modified herein shall remain in effect.” This letter is SmartEnergy’s eleventh report pursuant to the Enforcement Order.
As earlier reported, on September 5, 2025, consistent with the timing prescribed in the Clarification Order, SmartEnergy mailed 22,609 letters, with checks, to consumers. Also as previously reported, SmartEnergy has been working with Chase Bank to ensure that customers do not experience problems negotiating their checks. As of the last bi-weekly report, the scope of the problem had been limited to consumers that attempted to cash their check in person at a Chase Bank. Since the submission of the last report, Chase Bank has advised SmartEnergy that it has corrected this issue and that there should be no problems moving forward.
SmartEnergy has timely responded to discovery from Staff and will continue to do so. Additionally, there is a meeting scheduled with Staff, CAD, and OPC on Friday afternoon, October 3, 2025, to discuss the status of the payments.
With respect to the checks already mailed, SmartEnergy continues to provide daily updates to Staff, CAD, and OPC. The update provided on Friday, October 3, 2025, showed that 6,567 checks have cleared totaling $2,149,193.
Finally, SmartEnergy has continued to meet with the independent auditor and is on schedule to mail the remaining checks on October 7, 2025 to former customers that were inactive in the applicable utility’s database and for whom the NCOA database did not have a new address. SmartEnergy sent each of those customers a letter asking them to verify their address within 30 days, pursuant to the Clarification Order.
