PUC Staff Files Petition To Revoke REP Application For Failure To File EOP
Excerpts from PUCT Staff’s Petition to Revoke Onxy Electric Energy’s REP Certificate:
“The Staff (Commission Staff) of the Public Utility Commission of Texas (Commission) hereby files this petition to revoke the retail electric provider (REP) certificate of Onxy Electric Energy LLC (Onxy). In support thereof, Commission Staff would show the following:
“Onxy is registered with the Commission as an Option II REP under REP certificate number 10316.2 Because Onxy was registered as a REP after April 15, 2022, it was required to submit a copy of its emergency operations plan (EOP) and an executive summary in Project No. 53385 concurrent with its application for a REP certificate.”
“The Commission’ s Division of Compliance and Enforcement (DICE) opened an investigation into Onxy concerning its noncompliance with 16 TAC §25.53 on December 27, 2024, and issued an Open Letter and initial requests for information (RFIs) on January 16,2025. The Open Letter instructed Onxy to respond to DICE within five days of receipt of the letter and to return responses to the submitted RFIs within 20 days of receipt of the RFIs. Onxy failed to respond by either deadline. A copy of the Open Letter and initial RFIs are attached as Exhibit A.”
“On April 9,2025, DICE issued a Finding of Violation (FOV) related to Onxy’s failure to submit required filings in Project No. 53385 as required under 16 TAC § 25.53. The FOV instructed Onxy to file its EOP and executive summary in Project No. 53385 within 15 days of receipt of the FOV and to respond to DICE within 20 days of receipt of the FOV. The FOV further alerted Onxy that failure to respond to the FOV would result in an escalation in enforcement including, but not limited to, potential revocation of its REP certification. Onxy failed to comply with either deadline. A copy of the FOV is attached as Exhibit B.
“Accordingly, Commission Staff has initiated this petition to revoke Onxy’ s REP certificate number 10316.”
