DOER Issued An Update On CPS Rulemakings
Massachusetts DOER issued an update on Clean Peak Energy Standard (CPS) rulemakings.
Notice of Compliance was published in the Massachusetts Register on October 11, 2024, and confirmed that the changes made in the July 19, 2024 emergency rulemaking have been made permanent.
Effective immediately, the CPS ACP Rate will remain $45 through Compliance Year 2025.
Starting Compliance Year 2026, the ACP Rate will be $65 through Compliance Year 2032. Thereafter, the ACP Rate will be $45 and will hold fixed at that price for the remainder of the program. Additionally, DOER changed how long retail electric suppliers may bank a clean peak energy credit from three years to two years and changed the Summer Seasonal Peak Period from 3:00 – 7:00 p.m. ET to 4:00 – 8:00 p.m. ET.
DOER filed an emergency rulemaking with the Secretary of State that makes the following changes to 225 CMR 21.00 Clean Peak Energy Standard (CPS), effective immediately:
ACP Rate: The ACP Rate will remain $45 through Compliance Year 2025. Starting Compliance Year 2026, the ACP Rate will be $65 through Compliance Year 2032. Thereafter, the ACP Rate will be $45 and will hold fixed at that price for the remainder of the program.
CPEC Procurement: DOER has removed the initial 30% procurement target and Market Supply mechanism by which DOER might increase subsequent procurement targets are both removed. DOER will also establish a date by which it will publish a staggered procurement schedule.
CPEC Banked Compliance: DOER changed how long retail electric suppliers may bank a CPEC from three years to two years. Summer Seasonal Peak Period: DOER changed the Summer Seasonal Peak Period from 3:00 – 7:00 P.M. to 4:00 – 8:00 P.M. to reflect shifting of Summer peak over time.
Please note the Clean Peak Application portal and new PTS platform are available. CPS applicants should first register at www.nepoolgis.com for a CPS ID, and then visit MassCEC PTS to register the resource in PTS and then complete the CPS Statement of Qualification Application.
