DC Government And AltaGas File Response To PSC With Update On Settlement Negotiations
On behalf of the District of Columbia Government (DCG) and AltaGas Ltd. (AltaGas or the Company) (collectively, the Parties), the purpose of this letter is to update the Public Service Commission for the District of Columbia (Commission) on the status of the Parties’ settlement negotiations intended to resolve the issue of penalties that AltaGas should pay for its breach of Term No. 5 (F.C. 1142, Order No. 19396, Appendix A, issued June 29, 2018).
The Parties have made substantial progress in efforts to finalize the terms of a settlement, including developing a working draft of a consent decree. Upon finalization, the Parties will circulate the consent decree to the other parties in this proceeding and file it with the Commission for approval.
As such, the Parties jointly request that the Commission hold any order on the Term No. 5 penalty in abeyance for an additional 30 days, during which the Parties will work through the aforementioned process. Should the Parties not reach a final resolution before the end of this 30- day period, the Parties will file a joint status report with the Commission advising as to the status of negotiations. DCG reached out to the other parties in this proceeding to gauge their support for an additional 30-day penalty abeyance period, and the only party to respond within the requested time frame was the Office of Peoples Counsel for the District of Columbia who indicated they do not oppose this request.
