Vice Chair Motion Re: Investigation Into Conservation Services & 3rd Party Access To EDC Customer Data

{***} The July Secretarial Letter and FirstEnergy’s proposed Default Service Plan provide an avenue for access to the data for non-EGS parties. The Petitioners have not persuaded me to revisit this avenue before it has been given time to succeed.

THEREFORE, I MOVE THAT: 

  1. That the Petition for Reconsideration from Staff Action filed by Conifer, the Green Building Alliance, Keystone Energy Efficiency Alliance, Mission:data, and the National Energy Efficiency Fund is denied, consistent with this Motion. 
  2. That the Secretarial Letter dated July 3, 2023, is affirmed, consistent with this Motion. 
  3. The Office of Special Assistants shall prepare an opinion and order consistent with this Motion.  {***}
