NH DOE Files Proposed Interconnection of DER Rules
Proposed Rule Modified by Removing 5-megawatt Cap
The New Hampshire Department of Energy has filed the En 1000 final proposed rules in 2024-007 related to the Interconnection of Distributed Electric Energy Resources Procedure.
This filing was made with the goal of the ruleset being placed on the Joint Legislative Committee on Administrative Rules (JLCAR) meeting agenda on March 20, 2026, if possible.
The department is mindful that there might be further comments from OLS which will require the Department’s attention after today’s filing. If you wish to provide further comments for the Department’s consideration, please so by March 11, 2026 to ENGY.RulesGroup@energy.nh.gov, to allow time for the Department’s review prior to JLCAR.
Note that the Department modified the scope of the En 1000 rules, found at En 1001.01, by removing the 5-megawatt cap on distributed energy resources (DERs).

As background, on September 30, 2025, the Department of Energy filed a Rulemaking Notice and Initial Proposal with respect to the adoption of En 1000 Distributed Energy Resources Interconnection Procedures. The Rulemaking Notice was published in the Rulemaking Register on October 9, 2025. A public hearing on the Initial Proposal was held on December 11, 2025, pursuant to RSA 541-A:11, and notice was given that written comments should be submitted by December 18, 2025. On February 27, 2026, the Commissioner of the Department established the Final Proposal for adoption of En 1000.
Also note that the Department was adopting rules pursuant to RSA 12-P:5, IV, related to net metering and interconnection of distributed energy resources to the infrastructure of New Hampshire’s investor-owned electric utilities. The Department initially opened a single proceeding, RUL 2024-005, to adopt these rules, but after a November 18, 2024, stakeholder session, the Department decided to open a separate rulemaking proceeding, RUL 2024-007, to consider the interconnection rules. Going forward, RUL 2024-005 2024-005, will consider only the net metering rules. For information about the interconnection rulemaking before November 18, 2024, please see RUL 2024-005.
