Pepco Files Response To Office Of People’s Counsel Comments On Annual Merger Report

On July 1, 2024, the Office of People’s Counsel (OPC) filed its report on Delmarva Power & Light Company (Delmarva Power) and Potomac Electric Power Company (Pepco) (collectively PHI or the Companies) compliance with the Merger Conditions in Order No. 86990 as modified by Order No. 88128 related to the Pepco Holdings, Inc. merger with Exelon.  Although OPC does not allege that the Companies have failed to comply with the Conditions that OPC reviewed, OPC does raise certain issues that require a response from the Companies. Specifically, the Companies rebut OPC’s statement 1) that it has not verified cost recovery associated with certain merger conditions and 2) that the Commission should require Pepco to inquire with Montgomery and Prince George’s Counties on how merger funds were distributed.
