TPUC Enforcement Staff Withdraws Petition That Sought $128,000 Penalty Against Our Energy
In May 2024, Our Energy filed to relinquish its Option 1 retail electric provider certificate and the Commission the relinquishment request on August 2, 2024. In withdrawing its sought enforcement action and proposed penalty, Staff said, “Because Our Energy is no longer certificated as a REP and the violations at issue in this proceeding are limited to REP reporting requirements, Commission Staff has elected not to further pursue enforcement in this case.”
As background, enforcement Staff of the Texas PUC (TPUC) withdraw a petition against Our Energy, LLC that had sought the imposition of a $128,000 penalty for alleged violations of reporting requirements and the deadlines to respond to PUC Staff inquiries.
As previously reported, Our Energy sold its book of customers to Frontier Utilities in 2021.
However, Our Energy, LLC maintained its Retail Energy Provider (REP) certificate after the sale of the book sale to Frontier Utilities, though Our Energy has not served any Texas customers since the sale of its book to Frontier Utilities.
At issue in this matter, enforcement Staff had alleged that Our Energy failed to file annual and semi-annual reports starting in 2022. Enforcement Staff’s petition sought $128,000 fine reflecting a penalty between $200 to $500 for each day that the reports were not filed after the due dates, and $2,000 per each instance in which the REP allegedly failed to respond to Staff inquiries.
