PUCT Approves Staff’s Reliability Proposal And Sets Deadline For Comments

Per Staff report, PUCT approves Staff’s proposal for publication and set a deadline for stakeholder comments.  Interested persons may file comments electronically through the interchange on the commission’s website. Comments must be filed by July 15, 2024.

“The proposed rule will facilitate the implementation of Public Utility Regulatory Act (PURA) §39.159(b)(1) as revised by Section 18 of Senate Bill (S.B.) 3 during the Texas 87th Regular Legislative Session. The proposed rule will create a reliability standard for the ERCOT region, made up of three measures of loss of load events: frequency, magnitude, and duration.”

Previously on June 6, 2024, Staff filed memo and proposal for publication of new reliability standard.  Among other things Staff’s amend proposed rule: “(1) requires expected loss of load events to: (i) be less than 0.1 days per year; (ii) have a maximum expected duration less than 12 hours, with an exceedance tolerance of 1.00%; and (iii) have an “expected highest instantaneous level of load shed during a loss of load event” less than the “maximum number of megawatts of load shed that can be safely rotated” during an event, with an exceedance tolerance of 0.25%; (2) requires ERCOT, at least once every five years starting 1/1/26, to conduct an assessment of the region’s power system to determine whether it meets the reliability at that time and is likely to continue to do so for the following three years; and (3) requires PUCT to “review ERCOT’ s assessment to determine whether any market design changes are necessary.”

ERCOT filed its status update on the cost of new entry (CONE) study from third-party consultant Brattle, including a draft report. Of note: (1) to determine the new CONE, Brattle and its subcontractors.

As background, due to ERCOT failures during Winter Storm Uri, the Texas legislature via several pieces of legislation that directing the PUCT to develop reliability standards. This proceeding directs Staff to open a project to evaluate and establish an appropriate reliability standard in the ERCOT power region.
