EOE Files Motion For Approval Of Settlement With Arcadia Power; Arcadia To Pay $147,000
Re: Petition to Open Docket to Investigate Arcadia Power, Inc.
The investigation of Arcadia included several possible violations:
- operating as an electric supplier without a license
- operating as an aggregator without a certificate
- marketing to customers and/or entering contracts with customers in a deceptive and misleading manner regarding the services it offered, and/or not providing customers with any services for which the customers paid.
[ *** ] Arcadia agrees to pay the amount of one hundred forty-seven thousand dollars ($147,000) to the electric distribution companies (the “EDCs”) indicated as a payment to reduce hardship customer arrearages. Arcadia shall divide the payment as 80% ($117,600) to The Connecticut Light and Power Company d/b/a Eversource Energy and 20% ($29,400) to The United Illuminating Company. [ *** ]
PURA shall order the EDCs within sixty (60) days after receipt of funds from Arcadia, to apply the payments to the accounts of residential customers who are currently: a) designated financlal hardship; b) have never been designated medical hardship; and c) have arrearages greater than 180 days. The EDCs shall apply the payment to the portion of the customers’ arrearages greater than 180 days with a maximum of $1,000 applied per customer. Within seven business (7) days of applying all such payments, the EDCs shall make a compliance filing in Docket No. 24-03-04 indicating the number of customers receiving funds and the amount received by each customer.
Arcadia shall not engage in any business in the state of Connecticut regarding the sale of RECs, electric supply, or the representation of customers in securing an electric supplier without securing the proper license or certification first. To the extent Arcadia has engaged in any such business prior to the date of this Settlement Agreement, Arcadia shall immediately cease such business and shall terminate any agreements with Connecticut customers.
