ALJ Denies ComEd’s Motion to Define Grid Plan Scope
On July 2, 2026, the Illinois Commerce Commission (ICC) issued an order denying ComEd’s motion to define scope, given that “[t]he Grid Plan is intended to be a forum in which the… [parties] must consider ‘all related investments, planning processes, tariffs, rate design options, programs, and other utility policies and plans.”
“Effectively striking parties’ arguments at this phase of litigation runs counter to the Commission’s goals of integrity of the fact-finding process, fairness, expedition, convenience, and cost-effectiveness. See 83 Ill. Adm. Code 200.25. Furthermore, parties and the Commission are capable of navigating overlapping issues in multiple Commission dockets. To the extent clarity for future Grid Plans is needed, the parties may suggest proposals for Commission consideration.”
Previously, parties filed comments and replies on ComEd motion to define scope.
