ALJ Grants Spark Energy’s Request To Withdraw, Dismisses The Complaint Without Prejudice And Closes Docket

Re:  Complaint Of Spark Energy, LLC Against Centerpoint Energy Houston Electric, LLC

As previously reported, an ALJ had proposed dismissing the complaint as moot if Spark did not withdraw its complaint against CenterPoint energy.   The complaint stemmed from the utility refusing to disconnect Spark’s request to disconnect a designated critical care customer. Spark argued that substantive rule requires a TDU to execute a valid disconnect for non-payment regardless of the customer’s critical care status.

{***} This Order addresses the March 3, 2023 complaint of Spark Energy, LLC against CenterPoint Energy Houston Electric, LLC. On February 29,2024, Spark Energy filed a request to withdraw the complaint. Under 16 Texas Administrative Code (TAC) § 22.181(g)(1), the party that initiated the proceeding may withdraw the matter without prejudice before it has presented a direct case. The administrative law judge grants Spark Energy’ s request to withdraw, dismisses the complaint without prejudice under 16 TAC § 22.181(g)(5), and closes this docket.  {***}

From Spark Energy’s Withdrawal of Complaint:

{***} Pursuant to 16 TAC §§22.181(d)(10) and (g), Spark Energy, LLC (“Spark” or “Complainant”) files this Withdrawal of Complaint with Prejudice and would respectfully identify the following: 1. On or about March 3,2023, Spark filed its Formal Complaint against CenterPoint Energy Houston Electric, LLC (“CenterPoint”) with the Commission (the “Complaint”). 2. Spark now intends to withdraw its Complaint with prejudice as to all claims asserted by Spark against CenterPoint. WHEREFORE, premises considered, Spark respectfully requests that its Withdrawal of Complaint is granted. {***}
