Broker/Consultant Licensing Rules Are Now Effective
As previously reported on September 10, 2025 the New York Public Service Commission (PSC) issued the UBP & UBP-DERS modification proposal to the Uniform Business Practices (UBP).
Previously on September 10, 2025, in response to these proposed rule amendments the PSC issued a Notice Soliciting Comments. Parties were invited to submit comments on the proposal. Parties had 60 days after the issuance of an PSC order to comply with the adopted revisions.
No related comments were filed by the notice deadline.
As background, this proceeding was initiated to implement the registration of energy brokers and energy consultants pursuant to the Public Service Law. On August 28, 2025, Department of Public Service (DPS) staff filed a revised proposal regarding financial accountability for energy brokers and energy consultants. In the proposal, DPS staff recommended modifications to the UBP that apply to brokers, consultants and Distributed Energy Resource Suppliers (DERs) to include a bond as an acceptable form of financial accountability under Public Service Law §66- t(3).
