Commission Files Request For Comments In SB 1 Do Not Transfer List And Supplier Customer Prices Paid Reporting Requirements

The Maryland Commission is asking for comments on whether the monthly reports submitted by utilities and suppliers should be made public.

[ *** ] The Maryland Public Service Commission, in Order No. 91638, required regulated gas and electric utilities and retail gas and electric suppliers to file monthly reports in the PC67 docket, specifying prices paid by residential customers, in order to fulfill the reporting requirements of Annotated Code of Maryland, Public Utilities Art. (“PUA”) §§ 7-510(g) and 7-604.2(e), as enacted through Senate Bill 1. In the same Order, the Commission authorized gas and electric suppliers submitting data on total energy sales for supplier consolidating billing or dual billing customers to submit this information confidentially.

On September 2, 2025, Staff filed “Recommendations for Utility Reporting of Dual-Billing and Supplier Consolidated Billing for Residential Customer Prices Paid Reporting,” requesting that the Commission require utilities that serve retail customers to provide three tables, two of which would be confidential, as a part of their monthly reporting on prices paid by residential dual-billed and supplier consolidated billing (“SCB”) customers. The Maryland Office of People’s Counsel (“OPC”) and the Retail Energy Supply Association (“RESA”) filed subsequent comments, including recommendations regarding the proposed confidential filings. Staff filed additional comments addressing OPC’s response and stance on the proposed confidential filings.

In a notice the Commission invites interested parties to electronically submit comments addressing the following:

(1) whether it is in the public interest to require monthly price data under PUA §§ 7-510(g) and 7-604.2(e) to be filed publicly; and 

(2) any legal and policy considerations if monthly price data under PUA §§ 7-510(g) and 7- 604.2(e) is filed publicly, including the applicability of the Maryland Public Information Act.

Comments on this matter should be filed by November 7, 2025 in Docket PC67, and should be addressed to Andrew S.
