Commissioner Beverly Files Statement On Comments Received Regarding Pepco’s Interconnection Projects And Tax Credit Impact

[ *** ] I want to start by thanking all the respondents for their thoughtful comments in response to the Commission’s October 22, 2025, Notice of Inquiry. As everyone is aware, the window for obtaining federal tax credits is rapidly closing and, without the tax credit, projects caught in Pepco’s interconnection queue face the prospect of irreversible financial damage or loss of the project altogether. For eligibility to be certain, the project must be interconnected by the end of the year, so time is of the essence. To move this matter forward, I urge the Commission to immediately direct Pepco to institute non-exporting (or limited-exporting) interconnections for the projects in the queue as of October 31, 2025, and interconnect these projects by the end of this calendar year. To track Pepco’s progress, the Commission should also direct Pepco to provide bi-weekly reporting of the following items for the projects in the queue as of October 31, 2025 until each has received a final ATO: queue position, capacity, interconnection level, application date, ATI date, whether interconnection facilities are required, whether distribution system upgrades are required, start date of construction of upgrades (or anticipated start date), end date of construction of upgrades (or anticipated end date), date of notice to the customer of an interim non-exporting interim ATO option, date of receipt of customer’s acceptance of interim ATO option, interim ATO date, final ATO date (or anticipated final ATO date).
The stakeholders who responded to the NOI also made other recommendations for how to improve this Commission’s oversight of interconnection to improve timeliness and transparency, and I am prepared to address those recommendations and other changes through an immediate rulemaking.
