DOER Filed Emergency Clean Peak Energy Rulemaking– Effective Immediately
On July 19, 2024, DOER filed an emergency rulemaking with the Secretary of State that makes changes to 225 CMR 21.00 Clean Peak Energy Standard (CPS), effective immediately. This emergency rulemaking overrides the CPS emergency rulemaking filed on July 12, 2024, retains the change made to the 2024.
Minimum Standard in the July 12, 2024, CPS emergency rulemaking filing including:
- Changes the Minimum Standard from 2025 through 2050 and
- Adds a Near-Term Resource Multiplier for Qualified Energy Storage Systems that are not co-located with a Qualified RPS Resource or a Demand Response Resource and that are interconnected to the Distribution System.
A clean and redline version of the updated CPS Regulation can be seen below. Per G.L. c. 30A. DOER will hold a public hearing and comment period, dates and location will be announced via a stakeholder email announcement and posted below.

The Clean Peak Application portal and new PTS platform are available. CPS applicants should first register at www.nepoolgis.com for a CPS ID, and then visit MassCEC PTS to register the resource in PTS and then complete the CPS Statement of Qualification Application.
Previously on July 12, 2024, DOER filed emergency rulemaking setting the 2024 CPS minimum standard at 4% “in order to shelter ratepayers from the impacts of high Alternative Compliance Payment (ACP) collection during anticipated CPEC market undersupply conditions.“
As background, As required by law (see docket House Bill H.4857), DOER established the baseline minimum percentage of kWh sales by suppliers to end-use customers that must be met with clean peak certificates beginning on 1/1/19, setting it at 0%.
According to the law, DOER must establish seasonal peak periods, which are defined as “the daily time windows during any of the 4 annual seasons when the net demand of electricity is the highest; provided however, that a seasonal peak shall be not less than 1 hour and no longer than 4 hours in any season.” DOER must also establish a value for clean peak certificates for each MWh of energy or energy reserves during the seasonal peak period by creating an alternative compliance payment rate and potentially other mechanisms. Lastly, DOER must determine a metering and verification protocol.
