Electric Shopping Bill Introduced That Includes Shopping Cap And Queueing System For Nonresidential Customer

SB272 also entitled “Competitive electric generation service” has been introduced in the State of Indiana that provides beginning July 1, 2027, an eligible customer of an incumbent electricity supplier may elect to receive: (1) electric supply service directly from a competitive electricity supplier; and (2) transmission and distribution service from the incumbent electricity supplier. 

The bill defines an “eligible customer” as a new or existing nonresidential customer of the incumbent electricity supplier, or an aggregation of two or more such customers, whose aggregate electricity demand during the most recently concluded calendar year exceeded one megawatt. 

IURC rule must also include:

  • system for establishing and periodically adjusting a cap on an incumbent electricity supplier’s eligible customers receiving electric supply service from a competitive electricity supplier; and a
  • queue process by which eligible customers of an incumbent electric utility that elect to receive electric supply service from a competitive electricity supplier are authorized to begin receiving that service as the utility’s cap allows.

The bill also requires the IURC to issue a general administrative order to ensure that the following are available to customers not later than December 31, 2029: 

  • An expedited process for residential customers to change retail electric providers 
  • A process that allows residential customers or small commercial or industrial customers; that move from one service location to another within their electricity supplier’s service area to have their competitive electric generation service transferred directly to the new location.
