EOE Provides Guidance To Licensed Suppliers Regarding Regulation Changes In Security Requirements

Pursuant to the new regulations, an electric supplier shall maintain an amount of security based on its forecast year load.

From EOE Letter to Suppliers: 

  1. Pursuant to the new regulations, an electric supplier shall maintain an amount of security based on its forecast year load, as Licensing Security, in accordance with the schedule below. The forecast year load shall be the amount of the full load served by the electric supplier during the previous calendar year, as adjusted to account for changes in the type and quantity of customers to be served in the forecast year. Additionally, for any forecasted year load in excess of 1,500,000 MWh, the authority shall have the discretion to increase the Licensing Security in increments of one million dollars for each additional 500,000 MWh of annual load indicated by a decision in the supplier’s licensing docket. a. Up to 100,000 MWh: $250,000; b. 100,001 MWh to 499,999 MWh: $500,000; c. 500,000 MWh to 999,999 MWh: $1 million; and d. 1,000,000 to 1,500,000 MWh: $2 million. 
  2. Pursuant to the new regulations, electric suppliers are required to, in addition to its RPS security requirements pursuant to subsection (b) of section 16-245a1 of the Regulations of Connecticut State Agencies, maintain a security amount that is continuous without an expiration date covering the term of the electric supplier’s license and shall be revised annually.
  3. Pursuant to the new regulations, the amount of security maintained to comply with this section may be satisfied by (1) adding the amount of security required by this section to the security the electric supplier uses to comply with the security requirements of subsection (b) of section 16-245a-1 of Conn. Agencies Regs., or (2) maintaining a separate security in the amount required by this section.
  4. Pursuant to the new regulations, all electric suppliers shall submit the necessary revisions of the security in their original licensing docket on or before October 15, 2024 and annually thereafter. In addition to the requirements of Conn. Agencies Regs. § 16-245-4, EOE requests that each electric supplier file, along with the revisions to its Licensing Security, their projected forecast year load. Unless otherwise notified, this will be required going forward and will be due annually in each suppliers’ licensing docket on the date that required RPS compliance filings are due, as stated in the Notice of Proceeding in each RPS annual docket.
  5. EOE respectfully requests that each electric supplier file their revised security in this year’s current RPS Docket, Docket No. 24-06-01, in addition to filing in their original licensing docket. [ *** ]
