ESCO Files Response to PSC’s Show Cause Order

On September 28, 2026 Median Energy filed a redacted response to the New York PSC’s order to show cause order.

“The extraordinary remedy of revocation is not warranted. The OTSC expressly recognizes that the allegations summarized in the OTSC are preliminary and do not constitute final findings of fact or conclusions of law. Taken as a whole and together with Median’s detailed responses to the underlying Notices of Apparent Violation (“NOAVs”), the allegations do not establish the pervasive disregard of Commission requirements suggested by Department of Public Service (“DPS”) Staff (“Staff”). Rather, the seven allegations fall into materially different categories that should not be collapsed into a single theory of systemic noncompliance.”

In its response Median acknowledges and states it has corrected violations involving third-party marketing vendor disclosures, power to choose postings, and broker compensation disclosures.

Median, however, disputes allegations of unauthorized golden ticket promotions, deceptive door-to-door marketing, and improper third-party verification.

Median also contests allegations that it offered an unapproved Home Warranty Product (HWP) to 463 mass-market customers, citing prior approval in 2023 and extended compliance deadlines. New York PSC Staff approved the revised HWP agreement on June 28, 2026.

Median also highlights corrective measures, including enhanced vendor oversight, revised sales training and contracts, and expanded compliance monitoring, and argues that revocation is unwarranted.

Median requests that the New York PSC impose no additional consequences or consider targeted compliance conditions instead.
