Initial Briefs Filed In Utility’s Modernization Rider
OCC filed in-depth recommendations asking the Commission to “restore the public trust in the PUCO.”
Northeast Ohio Public Energy Council commented that the PUCO should impose the recommended forfeitures totaling $137,075,000 and order the recommended restitution in the amount of $457,731,456, plus interest, for the benefit of the utility customers. Additionally, the PUCO should order a further audit of rider DCR.
RESA and IGS commented that the PUCO “should modify FirstEnergy’s corporate separation plan, issue a new order expressly precluding FirstEnergy from forming competitive affiliate for at least 10 years, require FirstEnergy to pay restitution for the harm it caused to Ohio’s competitive marketplace, and direct that forfeiture procedures be initiated.”
