Liberty Filed Response To DOE Motion For Clarification
Liberty filed response to DOE motion for clarification Of note, Liberty: (1) said that it “has expanded the scope of work to be performed” by PricewaterhouseCoopers (PwC) to include assessment of its 2023 calendar year data including review of its 2023 general ledger and a FERC Form 1”; (2) argued that requiring it to create 2023-based revenue schedules “would not only delay the proposed third-party review as preparation of such schedules would requires months to undertake but effectively requires the filing of a new rate case since 2023 is not a test year before the Commission in this case.”
PwC report due by April 8, 2024. 4/8/24. The proceeding now stayed through April 15, 2024.
On March 5, 2024, DOE filed correction of misstatement and motion for clarification and request for record request Of note, DOE said that, contrary to Liberty’s assertions, it did not decline an offer to provide input” concerning a third-party review, but “was not presented with a detailed scope to review.”
As background the utility proposes to increase rates to yield an annual increase of $15,487,002 in distribution revenues to be effective 7/1/23, a temporary increase in distribution revenues of $6,732,801 annually to be effective 7/1/23, and approval of a three-year forward-looking multi-year rate plan (“MYRP”) for the rate years ending 6/30/24, 6/30/25, and 6/30/26.
