PSC Energy Storage Working Group Seeks To Resume The Energy Storage Rulemaking
The Maryland Public Service Commission’s Energy Storage Initiative working group filed notice with the MD PSC asking the MDPSC to resume the energy storage rulemaking. Since a significant number of unresolved issues remain, the working group requested that the Commission issue a notice for comment to allow parties to raise related concerns.
In response the MD PSC issued a notice asking interested stakeholders to file comments on the proposed energy storage program regulations by January 29, 2025. A rulemaking session is scheduled for February 2, 2025.
The notice indicates that the group wants to address non-consensus issues with the proposed regulations. More specifically, the working group leader said, “In addition to many editorial changes and wording clarifications, the Workgroup also made several more substantial changes. In particular, the Workgroup confirmed the title of the Maryland Energy Storage Program and clarified confusion regarding enrolling and registering in the Maryland Energy Storage Program. In order to effectuate these changes, the Workgroup now recommends that components of the Maryland Energy Storage Program are now “Initiatives” instead of Programs.”
“In addition to reorganizing various parts of the proposed regulations, the Workgroup also modified several definitions including adding a definition for “cost-effectiveness” and aligned the definition of “construction” with Public Utilities Article, §7- 207(a)(3), Annotated Code of Maryland. The Workgroup also clarified some aspects of administering Initiatives within the Maryland Energy Storage Program including the processes associated with setting of targets for Initiatives, the counting of energy storage devices for enrollment and registration in the Maryland Energy Storage Program. The Workgroup also made project maturity requirements more flexible to be proposed for each Initiative and added a dispute resolution provision, among other things.”

The MDPSC opened this proceeding in response to legislation passed and signed into law earlier this year (HB910), which directed the MDPSC to establish “a Maryland Energy Storage Program that provides a competitive energy storage procurement program, with annual deployment targets for energy storage devices in Maryland.”
