New Solar Permitting Law Approved
HB711 was approved by the Governor on April 22, 2026.
This bill is effective July 1, 2026.
As amended on January 30, 2026 this bill deals with local permitting of ground-mounted solar energy generation facilities: (1) to be located on agricultural, commercial, industrial, or institutional property; (2) with a capacity of at least 1MW; and (3) for which approval is filed 7/1/26 or later. It would require that, unless otherwise permitted by right, such systems be considered according to criteria in local ordinances, e.g. setback specifications, panel height, and visual impacts.
