Newly Adopted ESCO UBP Rules Are Now Posted On PSC’s Website
The New York Public Service (PSC) has posted the updated UBP that reflects amendments to the New York Uniform Business Practices (UBP) rules and the Standard Renewal Notice to be consistent with provisions of New York’s General Business Law (GBL) §349-d, that created a bill of rights for energy service company (ESCO) consumers.
As reported previously, the order approving modifications to the UBP were approved by the Commission on November 13, 2025. The UBP applies to retail electric and gas suppliers.
Among other things the updated rule implements revisions to General Business Law (GBL) §349-d, that generally prohibits ESCOs from changing the rate charged to a customer without the customer’s affirmative consent.
The UPB rules are effective December 2025.
