OPC and Amtrak File Letter Regarding Rehearing Request and Clarification Of Order In BG&E’s Application Electric And Gas Multi-Year Plan

Excerpts from the OPC and Amtrak Letter

The Office of People’s Counsel (“OPC”) and the National Railroad Passenger Corporation (“Amtrak”) write regarding their respective pending requests for rehearing and clarification of Order No. 90948. The Commission issued Order No. 90948 approving Baltimore Gas and Electric Company’s second multi-year rate plan (“MRP”) on December 14, 2023. Amtrak and OPC filed requests for rehearing on January 12 and 16, 2024, respectively. Commission Staff filed a petition for clarification on January 16, 2024.  BGE, Staff, and IBEW Local 410 all filed responses to the requests for rehearing.

As of September 11, 2024, the requests for rehearing have been pending before the Commission for seven months. In the absence of a Commission order on rehearing and clarification, the outcome of the case and the resolution of the legal issues raised in the rehearing and clarification requests are uncertain. Amtrak and OPC respectfully ask whether the Commission intends to issue a ruling on the pending requests for rehearing.
