Office Of People’s Counsel And Consumer Affairs Division’s Counsel File Response To SunSea’s Motion For Stay

SunSea argues that a stay should be granted due to the overlap of issues between the Pre-Trial Statements and SunSea’s Petition for Circuit Court review.  

The Consumer Affairs division does not oppose SunSea’s Motion to Stay.  The Consumer Affairs Division is confident in the merits of its case before the PULJ and is also confident that the Circuit Court will uphold the Commission’s findings in every way. 

From OPC’s letter: 

OPC opposes SunSea’s Motion for Stay of Evidentiary Proceedings because it would: 1) effectively stay Commission Orders No. 90581 and 90614; 2) further delay a proceeding that was supposed to be resolved expeditiously; 3) not serve judicial or administrative economy; and 4) not prejudice SunSea to hold the February 15 – 16 evidentiary hearing as scheduled.
