OPC Recommends Approving United American Marketing Corp.’s Application For Electric Supplier License After Payment Of Penalty For Operating Without A License

[ *** ] On July 2018 and May 2020 respectively, UAM began operating in Maryland without a license as a broker on behalf of Constellation New Energy and Energy Harbor. After being notified by Constellation New Energy that it must obtain a license to continue operating as a broker, UAM said it ceased its Maryland operations on September 3, 2022, and applied on October 23, 2023, for a license to broker electricity and supply electricity related services. UAM collected $21,129.40 from its Maryland operations, which it specified in the public version of its application.  However, UAM “never paid Commission assessments, maintained financial security in the form of a bond, or maintained contact info with the Commission.” [ *** ]

Pursuant to PUA § 13-201(d) and the Commission’s licensing authority under PUA § 7-507, OPC agrees with Staff’s recommendation that prior to approving UAM’s application, the Commission should require UAM: (1) to pay a civil penalty of at least $3,067.34 for operating in Maryland without a license for several years; and (2) direct UAM to notify the Commission within 30 days of any changes to the information upon which the Commission relies on in granting the license.  Additionally, OPC recommends that the Commission should, pursuant to the MPIA, require the confidential version of Staff’s comments to be refiled as an unredacted public version.
