PSC Issued A Declaratory Ruling On The Transferability Of Tier 1 RECs

The New York Public Service Commission (PSC) issued a declaratory ruling on the transferability of Tier 1 renewable energy credits.  In this order, the NYPSC reaffirms that LSR project owners may sell Tier 1 RECs not contracted with NYSERDA to third parties. It also confirms that, under the ESCO Reset Order, ESCOs may purchase voluntary RECs from sources other than NYSERDA, but must obtain Tier 1 compliance RECs directly from NYSERDA.
