PSC Issues Order Re: Energy Storage Utility Dispatch Rights
The New York PSC issued an order approving Con Edison’s request to clarify that all investor-owned utilities can extend the in-service deadline for Utility Dispatch Rights (UDR) energy storage projects beyond December 31, 2030, using the same criteria available to NYSERDA projects. An extension is allowed when construction begins by December 31, 2030 and the delay is caused by circumstances beyond the developer’s control, such as interconnection or permitting delays. The NYPSC determined that this flexibility applies to all UDR projects and supports the effective buildout of New York’s energy storage capacity.
Previously, on August 7, 2026 Con Edison filed a notification that they have extended the deadline to submit proposals for its 2026 Bulk Energy Storage Utility Dispatch Rights (UDR) RFP from July 17, 2026 to September 4, 2026. The new deadline applies to all eligible bidders.
On August 6, 2026 Con Edison filed an amended petition asking the New York PSC to clarify that the deadline-extension rules for energy storage projects also apply to projects procured by investor-owned utilities, not just NYSERDA. The NYPSC requires projects to be in service by December 31, 2030, but allows extensions for delays outside a developer’s control. Con Edison argues that applying the same criteria to utility-procured projects would ensure consistent treatment, provide flexibility for development delays, and support New York’s 6 GW energy storage goal.
Also on August 6, 2025, the New York PSC filed a notice soliciting comments. In this, Con Edison asked the NYPSC to confirm that its energy storage projects can receive the same in-service deadline extensions available to NYSERDA projects and to shorten the comment period from 21 days to 5 days. Comments were due by August 11, 2026
The deadline for submitting prospective bidder qualifications was August 7, 2026.
Subsequent qualified bidder prospective project bid proposals are due by September 14, 2026.

As background, this proceeding was initiated to implement Gov. Cuomo’s energy storage initiative. The Energy Storage Roadmap, released as part of Gov. Cuomo’s announcement, identifies approximately 60MW of advanced energy storage capacity already deployed in the state, with another 500MWs’ worth of projects in the pipeline.
