PSC Temporarily Suspends Utility’s SOS Price Cap Reporting
The Maryland PSC issued an order temporarily suspending the utility’s monthly SOS price cap reporting.
The Commission directs electric utilities to pause monthly trailing 12-month average SOS reporting. The Commission will provide instructions for electric utility reporting under the Act at a later date.
As background, during its 2026 session, the Maryland General Assembly passed the Utility RELIEF Act (“the Act”).1 Among other things, the Act modified price caps for residential electric retail choice suppliers that offer non-green power contracts, from the trailing 12-month average standard offer service (“SOS”) rate to: (1) 100% of the SOS rate for contracts not exceeding 23 months; (2) 105% of the SOS rate for contracts between 24 months to 35 months; and (3) 110% of the SOS rate for contracts up to 36 months.
“In Order No. 91237, the Commission directed each electric and gas utility with retail choice in its service territory to submit to the Commission its calculated 12-month trailing average, as well as its monthly updated 12-month average, and to post the averages in a prominent website location so that suppliers could easily access the data. In Order No. 9156 the Commission directed electric and gas utilities to file their averages by the 5th business day of the month.”
On July 24, 2026, the Commission’s Technical Staff (“Staff”) filed its Request to Pause Utility PC 64 Price Cap Reporting to Comply with 2026 Utility RELIEF Act.4 Staff argued that by amending PUA § 7-510(d), the Act changed the statutory requirements for determining the price caps, thereby necessitating a revision in the reporting by utilities in the PC 64 docket. In its filing, Staff requested that the Commission order a pause of trailing 12-month average SOS price cap reporting prior to August 5, 2026. Furthermore, Staff noted that it has convened stakeholders to update price cap reporting to align with the Act.
