Reminder – Net Metering Rulemaking Effective July 8, 2024

The Maine Public Utilities Commission (MEPUC) issued order adopting the rule approved May 6, 2024. The adopted rule has an effective date of July 8, 2024.
As a reminder, the revised rule:
- adds or revises definitions for “benefits of distributed generation under net energy billing,” “net energy billing,” and “eligible facility,” with this last clarifying eligibility components resulting from various legislation and including “the exceptions that apply for an NEB facility serving a customer that is a municipality, or a customer that is located in the service territory of a consumer-owned transmission and distribution utility”;
- reflects legislative changes requiring expired kWh program credits to “be monetized by the T&D utilities and remitted to the Commission, which will forward these funds to the Maine State Housing Authority to be disbursed as part of the Low Income Assistance Program”;
- establishes a method for monetization of expired credits: (i) for residential class credits, “utilities will monetize the value using the transmission and distribution rate and the standard offer rate per kilowatt hour in effect as of December 31 of the year in issue”; and (ii) for credits “for any commercial or industrial customers participating in the kilowatt hour program, the utilities will use the transmission and distribution rate in effect as of December 31, as well as an average of the standard offer rate in effect during the year in issue”;
- imposes “joint responsibility on Project Sponsors and the utilities to identify metering issues in a timely manner” and correcting them “within the time period required by ISO- NE tariff or market rules”; and
- sets out “a comprehensive analysis that must be conducted on an annual basis to determine and allocate the costs and benefits of NEB,” including clarifying “the process used to determine NEB costs,” which continues past practice.
