SmartEnergy Files Fourth Bi-Weekly Compliance Report

[ *** ] On April 28, 2025, the Commission entered Order No. 91626 (“Enforcement Order”) directing SmartEnergy to, among other things, submit bi-weekly reports on its progress complying with the Order. On June 9, 2025, the Commission issued an Order No. 91676 ( “Clarification Order”) modifying portions of the Enforcement Order and holding that “[a]ll other directives of the Enforcement Order not modified herein shall remain in effect.” This letter is SmartEnergy’s fourth report pursuant to the Enforcement Order.

In the third biweekly report, SmartEnergy reported that it had received from BGE, Pepco, and Delmarva information as to whether each former SmartEnergy customer is an “active” or “inactive” customer for the respective utility, and SmartEnergy had forwarded a spreadsheet to PE so that PE could provide the same information. That status has not changed. The Commission, in the Clarification Order, directed the utilities to provide available email addresses to SmartEnergy for inactive customers for whom the NCOA database does not provide an address different from the address that the utility and SmartEnergy have on file. Over the course of the next few weeks, SmartEnergy will be utilizing the NCOA and coordinating with each utility to obtain the relevant email addresses.

Additionally, SmartEnergy has formally retained Abrams, Foster, Nole & Williams, P.A. (“AFNW”) as its independent auditor pursuant to the Enforcement Order. 1 SmartEnergy is meeting with AFNW on Thursday, June 26, 2025.
