Tentative Global Settlement Inches Closer In EME Supplier Investigation
The Maine Public Utility Commission (MEPUC) issued procedural order announcing that “a global settlement had been reached with EME, Advocacy Staff, and the OPA all joining” and CMP expected to join. A settlement update was filed on September 13, 2024.
Settlement Update:
{***} “In response to the September 5, 2024, Procedural Order issued in the above-referenced proceeding, Electricity Maine, LLC reports on behalf of the parties that an Amended Stipulation and other settlement-related documents have been circulated among the parties for comment and remain under active review. The parties presently expect that an Amended Stipulation can be filed by September 20, 2024. {***}
Excerpts from the Procedural Order:
{***} A conference of counsel in this matter was held on September 4, 2024. Commission Advocacy Staff, Electricity Maine, LLC (EME), the Office of the Public Advocate (OPA), and Central Maine Power (CMP) all attended. As noticed, the purpose of the conference was to determine next procedural steps and gain clarity into the status of disputed discovery requests propounded by the OPA on EME.
At the conference, parties informed the Hearing Examiners that a global settlement had been reached with EME, Advocacy Staff, and the OPA all joining the settlement. CMP learned about the settlement at the conference due to the recentness of the settlement. It is currently unknown whether CMP will join the settlement but parties anticipated CMP to take the same position it had taken in the previous settlement in this matter. Noting the time required to resolve outstanding issues, and to prepare a stipulation with a memorandum, the Hearing Examiners requested an update on the settlement on September 13, 2024. Parties should note in the update when they expect the stipulation to be filed. {***}
