Staff And Enerwise Reach $240,000 Penalty Settlement

The Staff of the Public Utility Commission of Texas (Commission) and Enerwise Global Technologies LLC (Enerwise) (together, the Parties) enter into this settlement agreement and file this joint report to the Commission. The agreement resolves and concludes Commission Staff’ s investigation of Enerwise for violations of PLJRA1 § 39.151(j); 16 Texas Administrative Code (TAC) §§ 25.503(f)(2), (6), and (8) and 25.507(d)(6); ERCOT Nodal Protocols2 § 8.1.1.3, related to responsive reserve service (RRS); and 16 TAC 25.503(g)(3) and ERCOT Nodal Protocols §§ 8.1.3.2 and 8.1.3.1.4, related to emergency response service (ER-S).

The report and recommendation has been forwarded to the Commission for approval.

Excerpts from Administrative Penalty:

 {***} 37. Under PURA § 15.023 and 16 TAC § 25.8(b), the Commission is authorized to impose an administrative penalty of up to $25,000 per day for Class A violations, up to $5,000 per day for Class B violations, and up to $1,000 per day for Class C violations. 

  1. The violations described herein are Class A violations under 16 TAC § 25.8(b)(3)(B)(xi). Docket No. 57381 Settlement Agreement Page 7 of 10 
  2. Commission Staff recommends, and Enerwise agrees to pay, an administrative penalty of $240,000 for the violations discussed in this settlement agreement, payable in 12 monthly payments of $20,000. 
  3. The Parties agree that the recommended administrative penalty is reasonable.
